SACRAMENTO, Calif. — A Sacramento County Superior Court judge says a trial in the second phase of a lawsuit against California's high-speed rail project can go ahead.
Judge Michael Kenny ruled Tuesday that he will hear arguments from attorneys representing a group of Central Valley farmers and landowners who argue that the state's $68 billion high-speed rail plan no longer complies with promises made to voters.
During the first phase of the lawsuit last year, Kenny ordered the state to rewrite its financing plan for the bullet train plan and prevented the state from selling bonds to pay for it.
The state appealed those decisions, and attorneys for the rail authority argued that Kenny should not hold additional hearings. No date has been set for the new trial.
