The fate of the seals at the La Jolla Children's Pool is now is the hands of the San Diego City Council.
A Superior Court judged has thrown out a 2005 state ruling that ordered the city to remove the seals from the Children's Pool and restore the beach to its 1941 condition.
A new law goes into effect on January 1 that broadens the scope of acceptable uses for the beach. It also gives control of the Children's Pool to the city council. Judge Timothy Taylor ruled that nothing would be gained by enforcing the 2005 ruling for a month-and-a-half. San Diego City Attorney Jan Goldsmith said he's happy with the ruling.
“Hopefully it means the decisions will now be in the hands of the city council and mayor the way policy decisions were supposed to be made and we're out of the courts,” he said.
Goldsmith said he hopes this brings an end to other lawsuits that involve the Children's Pool.
